bluetooth access point

I would like to know how my mobile phone could be detected from a bluetooth access point without requesting permission?
Should I modify the software of the phone or the one of the access point?

The detection phase should be possible without permission. If you try to run the Find and Connect sample and have a cell phone in the proximity (unbonded) the cell should come up anyway.

It is when you try to connect to the phone that permission will be required no matter what. That is part of the security protocols of Bluetooth and can't really be worked around. Some phones (and most devices) don't require constant grants of permission for connections, whereas it will (almost?) always be required that you bond the devices first.
